Congress never gave the FDA power to control medical practive. But, Reason reports, the agency seized it anyway -- by regulating software and computers. Now, all software used for medical purposes, or used to make a medical device, is presumed to be a device, and is subject to regulation, unless the FDA specifically exempts it.
